¡¡¡¡Chapter I General Provisions
¡¡¡¡
¡¡¡¡Article 1
¡¡¡¡For the purposes of standardizing the properties of Shanghai Arbitration
Commission (hereinafter referred to as this Commission), ensuring that economic
disputes be impartially and promptly arbitrated, and protecting the legitimate
rights and interests of relevant parties, these Regulations are formulated on
the basis of the¡°Arbitration Law of the People's Republic of China¡±(hereinafter
referred to as the Arbitration Law),.
¡¡¡¡Article 2
¡¡¡¡
¡¡¡¡This Commission was organized by Shanghai Municipal People's Government,
and established by registration according to law.
¡¡¡¡Article 3
¡¡¡¡
¡¡¡¡This Commission arbitrates the application for the contractual disputes and
other property rights disputes among natural persons, legal entities and other
organizations of equal status.
¡¡¡¡This Commission shall not arbitrate the application for disputes over labor
issues and agricultural contracting disputes within a rural collective economic
organization according to law.
¡¡¡¡This Commission shall not arbitrate the following disputes according to
law:
¡¡¡¡1. disputes over marriage, adoption, guardianship, maintenance, support and
assistance, upbringing and inheritance;
¡¡¡¡2. administrative disputes which according to law are to be handled by
administrative organs.
¡¡¡¡
¡¡¡¡Chapter II The Arbitration Commission
¡¡¡¡
¡¡¡¡Article 4
¡¡¡¡
¡¡¡¡This Commission is composed of one director, two to four vice directors and
seven to eleven members.
¡¡¡¡This Commission has one secretary general, whose post may be concurrently
held by the resident full-time member.
¡¡¡¡The list of members of this Commission shall be submitted to the China
Arbitration Association for the record.
¡¡¡¡Article 5
¡¡¡¡
¡¡¡¡Meetings of this Commission shall be presided over by the director or the
deputy director appointed by him. A meeting shall be held at the presence of 2/3
members. Resolutions on amendment to These Regulations or on dissolution of this
Commission shall be passed by over 2/3 of members, and resolutions of other
kinds shall be passed by the meeting at the presence of 2/3 members.
¡¡¡¡Article 6
¡¡¡¡
¡¡¡¡The main functions and duties of this commission are:
¡¡¡¡1. deliberating major issues such as working guidelines and working
programs of this Commission, and making corresponding resolutions;
¡¡¡¡2. examining and passing the annual working report and financial report
submitted by the secretary general;
¡¡¡¡3. deciding on the selection of the secretary general;
¡¡¡¡4. examining and passing the scheme for the set-up of the administrative
department of this Commission;
¡¡¡¡5. deciding on the appointment and dismissal of arbitrators;
¡¡¡¡6. amending the Regulations of this Commission;
¡¡¡¡7. making resolution on the dissolution of this Commission; and
¡¡¡¡8. other functions and duties provided by the Arbitration Law, Arbitration
Rules and These Regulations.
¡¡¡¡Article 7
¡¡¡¡
¡¡¡¡The director, vice directors and the secretary general shall form a
council, responsible for major works of this Commission when it is not in
session.
¡¡¡¡The director of this Commission may, as situation requires, appoint a
deputy director to assist him in handling major routine works of this
Commission.
¡¡¡¡Article 8
¡¡¡¡
¡¡¡¡This Commission may, as situation requires, set up a consultative panel of
experts to provide this Commission and its arbitrators advice.
¡¡¡¡Article 9
¡¡¡¡
¡¡¡¡Each term of office is three years for members of this Commission. Upon
expiration of the term, 1/3 of members shall be changed.
¡¡¡¡The change of the members of this Commission for the next term shall be
completed two months prior to the expiration of their current term of office. If
the change cannot be completed in due time owing to special circumstances, it
shall be completed within three months after the expiration of the term.
¡¡¡¡Each term of the Commission shall carry on its duties until a new term of
the Commission formed.
¡¡¡¡Article 10
¡¡¡¡
¡¡¡¡Members of the Commission for a new term shall be nominated by the last
council of the Commission.
¡¡¡¡Article 11
¡¡¡¡
¡¡¡¡If a resolution of termination of this Commission is made at the session,
this Commission shall terminate, upon the cancellation of registration with the
organ concerned.
¡¡¡¡
¡¡¡¡
¡¡¡¡Chapter III Administrative Department
¡¡¡¡
¡¡¡¡Article 12
¡¡¡¡
¡¡¡¡The secretariat is the administrative department of this Commission,
responsible for handling routine work under the leadership of the Secretary
General of this Commission.
¡¡¡¡The main functions and duties of the secretariat are:
¡¡¡¡1. particularly attending to procedural affairs including acceptance of
cases of arbitration, delivery of arbitration documents, taking notes during
hearings, assisting in the preparation of arbitration documents and
administration of arbitration files;
¡¡¡¡2. collecting and administering arbitration fees; and
¡¡¡¡3. handling other matters assigned by this Commission.
¡¡¡¡
¡¡¡¡Chapter IV Arbitrators
¡¡¡¡
¡¡¡¡Article 13
¡¡¡¡
¡¡¡¡The list of arbitrators shall be put forward by the council of this
Commission and be appointed and issued the certificates of appointment upon
examination and approval at the session of this Commission.
¡¡¡¡The term of appointment for an arbitrator is three years and the
appointment may be renewed upon its expiration.
¡¡¡¡Article 14
¡¡¡¡
¡¡¡¡The lists of arbitrators of this Commission are kept according to
specialties and reported to China Arbitration Association for the record.
¡¡¡¡Article 15
¡¡¡¡
¡¡¡¡Arbitrators shall strictly observe the provisions of the interim
arbitration rules of this Commission and guarantee the rights of the parties
concerned provided in the interim arbitration rules.
¡¡¡¡Article 16
¡¡¡¡
¡¡¡¡Arbitrators shall treat both parties concerned equally and observe the rule
of withdrawal as provided in the interim arbitration rules of this Commission,
and may not stand for or be partial to either of the parties.
¡¡¡¡Article 17
¡¡¡¡
¡¡¡¡Arbitrators shall, upon acceptance of cases, study conscientiously and
carefully all the evidence and materials submitted by the parties concerned and
shall do well the preparatory work for arbitration.
¡¡¡¡Article 18
¡¡¡¡
¡¡¡¡During hearings of cases, arbitrators shall fully listen to the statements
made by the parties and conscientiously find out the facts.
¡¡¡¡Article 19
¡¡¡¡
¡¡¡¡Arbitrators shall meet with the parties or their agents upon the approval
of the arbitration tribunal or this Commission at the place designated by this
Commission; without the consent of the arbitration tribunal or this Commission,
arbitrators shall not privately meet with either of the parties or agents, nor
individually accept the evidence and materials from one of the parties or
agents, nor hold talks with one of the parties or agents about the situation of
the cases.
¡¡¡¡Article 20
¡¡¡¡
¡¡¡¡Arbitrators shall, in due time, proceed with joint deliberation and prepare
relevant arbitration documents as prescribed.
¡¡¡¡Article 21
¡¡¡¡
¡¡¡¡Arbitrators shall not disclose to public the arbitration process of cases
and shall strictly keep confidential the contents of the joint deliberation by
the arbitration tribunal, and the commercial secrets involved in the cases, etc.
¡¡¡¡Article 22
¡¡¡¡
¡¡¡¡An arbitrator shall be dismissed by this Commission if any one of the
following circumstances are found:
¡¡¡¡1. concealing the state of affairs necessitating a withdrawal from his/her
post thus bringing forth an adverse effect on the case of arbitration;
¡¡¡¡2. being not present at the tribunal for oral hearing of the case without
justifiable reasons;
¡¡¡¡3. other facts making him/her unqualified to be an arbitrator.
¡¡¡¡Article 23
¡¡¡¡
¡¡¡¡An arbitrator shall be removed from the list of arbitrators by this
Commission if he/she is found in any one of the following circumstances and the
arbitrator himself/herself shall bear legal responsibilities according to law:
¡¡¡¡1. privately meets with the parties or their agents or accepts their
invitation or gifts and the case is serious;
¡¡¡¡2. when arbitrating cases, commits the act of demanding or accepting
bribes, practicing graft, or bending the law when making award.
¡¡¡¡Article 24
¡¡¡¡
¡¡¡¡Arbitrators shall attend the training courses organized by this Commission
and meetings held by this Commission.
¡¡¡¡Article 25
¡¡¡¡
¡¡¡¡Arbitrators shall, by handling cases of arbitration, earn remuneration
according to the provisions of this Commission.
¡¡¡¡
¡¡¡¡Chapter V Finance
¡¡¡¡
¡¡¡¡Article 26
¡¡¡¡
¡¡¡¡This Commission shall practise independent accounting in finance.
¡¡¡¡Article 27
¡¡¡¡
¡¡¡¡The funding sources of this Commission are:
¡¡¡¡1. financial aid from the government;
¡¡¡¡2. arbitration fees paid by the parties;
¡¡¡¡3. other legitimate income.
¡¡¡¡Article 28
¡¡¡¡
¡¡¡¡This Commission shall carry out the liquidation of its property when it
terminates. After liquidation, the property left over shall belong to the State.

¡¡¡¡Chapter VI Supplementary Provisions
¡¡¡¡
¡¡¡¡Article 29
¡¡¡¡
¡¡¡¡This Commission is located in Shanghai.
¡¡¡¡Article 30
¡¡¡¡
¡¡¡¡This Commission is responsible for the interpretation of These Regulations.
¡¡¡¡Article 31
¡¡¡¡
¡¡¡¡These Regulations shall take effect upon being adopted at the session of
this Commission. |
